Thus, citizens who have a higher or secondary medical education of the Russian standard and a specialist certificate can engage in medical activities. It is possible to determine what specific education and certificate an applicant for the position of a medical worker must have using: • qualification requirements approved by Order of the Ministry of Health and Social Development of Russia dated July 7, 2009 No. 415 n (for specialists with higher medical and pharmaceutical education); • qualification requirements for a specific position, specified in the unified qualification directory, approved by order of the Ministry of Health and Social Development of Russia dated July 23, 2010 No. 541 n (for specialists with secondary medical and pharmaceutical education). Qualification requirements for positions of medical workers in dental institutions are also established by Order of the Ministry of Health and Social Development of the Russian Federation dated December 7, 2011 N 1496 n “On approval of the Procedure for providing medical care to the adult population for dental diseases”: According to the order of the Ministry of Health and Social Development of Russia dated July 7, 2009 No. 415 n in the presence of a higher education education in the specialty “General Dentistry”, as well as internship, a medical worker can occupy the positions of: dentist; head of a structural unit - dentist. To occupy the position of a dental therapist, you must additionally complete a residency in the specialty “Therapeutic Dentistry” or have professional retraining in the specialty “Therapeutic Dentistry.” At the same time, we note that according to Order of the Ministry of Health and Social Development of the Russian Federation dated July 23, 2010 N 541 n, persons who do not have the appropriate additional professional education or work experience established by the qualification requirements, but have sufficient practical experience and perform efficiently and in full the job responsibilities assigned to them, on the recommendation of the certification commission of a medical organization, as an exception, they can be appointed to the appropriate positions as well as persons with special training and the necessary work experience. The employer takes measures for further professional training of the mentioned persons. When making such a decision, the employer must assess the risks associated with compliance with licensing requirements for the level of education of personnel. When hiring, doctors, like all other employees, submit documents to the organization in accordance with Article 65 of the Labor Code of the Russian Federation. At the same time, the presentation of documents confirming the availability of appropriate medical education is a mandatory condition for employment. This is explained by the fact that only those citizens who have received a special education and a specialist certificate have the right to engage in medical (pharmaceutical) activities, and therefore to be hired as a medical worker. In particular, citizens who have a higher or secondary medical education of the Russian standard and a specialist certificate can engage in medical activities. The list of specialties in the healthcare sector is fixed by law. At the same time, the following is distinguished: the nomenclature of positions for medical workers and pharmaceutical workers (approved by order of the Ministry of Health of Russia dated December 20, 2012 No. 1183 n); nomenclature of specialties for specialists with higher and postgraduate education (approved by order of the Ministry of Health and Social Development of Russia dated April 23, 2009 No. 210 n); nomenclature of specialties for specialists with secondary education (approved by order of the Ministry of Health and Social Development of Russia dated April 16, 2008 No. 176 n). This procedure is provided for by Order of the Ministry of Health of Russia dated November 29, 2012 No. 982 n. The form of the specialist certificate and the procedure for its issuance were approved by order of the Ministry of Health of Russia dated November 29, 2012 No. 982 n. Only educational or scientific organizations that have a license for educational activities have the right to issue a certificate (clause 3 of the order of the Ministry of Health of Russia dated November 29, 2012 No. 982 n). The specialist’s certificate has a validity period; therefore, when hiring a medical worker, it is necessary to pay attention to its suitability (Part 2, Article 100 of the Law of November 21, 2011 No. 323-FZ, Clause 1 of the Procedure approved by order of the Ministry of Health of Russia dated November 29, 2012 No. 982 n). It is possible to determine what specific education and certificate an applicant for the position of a medical worker must have using: qualification requirements approved by Order of the Ministry of Health and Social Development of Russia dated July 7, 2009 No. 415 n (for specialists with higher medical and pharmaceutical education); qualification requirements for a specific position specified in the unified qualification directory approved by order of the Ministry of Health and Social Development of Russia dated July 23, 2010 No. 541 n (for specialists with secondary medical and pharmaceutical education). For example, to fill the position of an obstetrician-gynecologist, an applicant must have a higher education in the specialty “general medicine” or “pediatrics”, postgraduate professional education (internship or residency), as well as a valid certificate of a specialist in the specialty “obstetrics and gynecology” (orders of the Ministry of Health and Social Development of Russia dated July 7, 2009 No. 415 n, dated July 23, 2010 No. 541 n). And a specialist with higher professional education in one of the specialties: “general medicine”, “pediatrics”, “medical and preventive care” or “dentistry”, postgraduate professional or additional professional education, can be hired for the position of deputy chief physician for medical affairs. as well as a certificate of a specialist in the specialty “health care organization and public health” (letter of the Ministry of Health of Russia dated May 14, 2014 No. 16-4/3023499-2412). An applicant with a higher medical (pharmaceutical) education, both completed and incomplete, without a specialist certificate, may be allowed to work in positions of nursing (pharmaceutical) personnel (Part 5 of Article 69 of the Law of November 21, 2011 No. 323-FZ ). The procedure for such admission is determined by the Regulations approved by order of the Ministry of Health and Social Development of Russia dated March 19, 2012 No. 239 no. Citizens with a medical (pharmaceutical) education who have not worked in their specialty for more than five years are allowed to engage in independent medical or pharmaceutical activities in their specialty only after completing additional training (professional retraining) and having a specialist certificate (clause 3, part 1, article 100 Law of November 21, 2011 No. 323-FZ). At the same time, medical specialists who have the specified break or want to try themselves in a new specialty can still be hired as trainee doctors for the period of training and perform their duties exclusively under the guidance of a medical specialist who has the appropriate certificate.
